Article 1 - Definitions
In these terms and conditions, the following definitions apply:
- Entrepreneur: Hygienepapier.nl;
- Customer: the natural person acting in the course of a profession or business and entering into a distance contract with the entrepreneur;
- Distance contract: a contract concluded within the framework of a system organised by the entrepreneur for distance selling of products and/or services, whereby up to and including the conclusion of the contract only one or more means of distance communication are used;
- Means of distance communication: any method that can be used for concluding a contract without the customer and entrepreneur being simultaneously present in the same place;
- Cooling-off period: the period within which the customer may exercise the right of withdrawal;
- Right of withdrawal: the possibility for the customer to withdraw from the distance contract within the cooling-off period;
- Day: calendar day;
- Duration transaction: a distance contract relating to a series of products and/or services of which the delivery and/or purchase obligation is spread over time;
- Durable data carrier: any means that enables the customer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.

Article 3 - Applicability
10. These general terms and conditions apply to every offer of the entrepreneur and to every distance contract concluded between entrepreneur and customer.
11. Before the distance contract is concluded, the text of these terms and conditions is made available to the customer. If this is not reasonably possible, it will be indicated before the contract is concluded that the terms and conditions can be inspected at the entrepreneur’s premises and will be sent free of charge upon request.
12. If the distance contract is concluded electronically, the terms and conditions may be made available electronically in such a way that the customer can easily store them on a durable data carrier. If this is not reasonably possible, it will be indicated where the terms can be consulted electronically and that they will be sent free of charge upon request.
13. If specific product or service conditions apply in addition to these terms, the customer may always rely on the provision most favourable to them in case of conflicting conditions.
Article 4 - The offer
14. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.
15. The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow proper assessment by the customer. Images are a truthful representation of the products and/or services. Obvious mistakes or errors do not bind the entrepreneur.
16. Each offer contains such information that it is clear to the customer what rights and obligations are attached to acceptance, including:
- price excluding taxes;
- how the agreement is concluded and the required steps;
- whether or not the right of withdrawal applies;
- payment, delivery or performance method;
- acceptance period or price validity period;
- archiving and accessibility of the agreement;
- how unintended actions can be corrected before conclusion;
- available languages besides Dutch;
- minimum duration in case of recurring deliveries/services.
Article 5 - The agreement
17. The agreement is concluded once the customer accepts the offer and meets the conditions.
18. If acceptance is electronic, the entrepreneur confirms receipt immediately. Until confirmation is received, the customer may cancel the agreement.
19. The entrepreneur ensures appropriate security measures for electronic transactions.
20. The entrepreneur may verify whether the customer can meet payment obligations and may refuse orders if justified.
21. The entrepreneur will provide the following information with the product/service:
- business address for complaints;
- withdrawal conditions;
- after-sales service and warranty information;
- information from Article 4(3) if not already provided;
- termination requirements for long-term contracts.
22. For ongoing deliveries, this applies only to the first delivery.
Article 6 - Right of withdrawal for products
23. The customer may cancel the contract within 14 days without giving any reason, starting the day after receipt.
24. The customer must handle the product carefully and may only unpack it as necessary to assess it. If withdrawing, the product must be returned in original condition and packaging.
Article 7 - Costs in case of withdrawal
25. Return shipping costs are borne by the customer.
26. Refunds will be made within 30 days after return or withdrawal.
Article 8 - Exclusion of withdrawal rights
27. Exclusion must be clearly stated in advance.
28. Exclusion applies to products:
- made to customer specifications;
- personal in nature;
- that cannot be returned;
- that spoil quickly;
- subject to financial market fluctuations.
29. Exclusion applies to services started with customer consent before cooling-off period ends.
Article 9 - Price
30. Prices will not increase during validity period except VAT changes.
31. Variable pricing may apply for market-dependent products.
32. Price increases within 3 months are only allowed by law.
33. After 3 months, increases are allowed if agreed and customer may cancel.
34. Prices exclude VAT.
Article 10 - Conformity and warranty
35. Products must conform to the agreement and legal requirements.
36. Manufacturer warranties do not affect legal rights.
Article 11 - Delivery and execution
37. Care will be taken in processing orders.
38. Delivery is made to the address provided by the customer.
39. Delivery will occur within 30 days unless otherwise agreed.
40. Refunds are made within 30 days of cancellation.
41. If substitution is necessary, the customer will be informed and return costs are covered by the entrepreneur.
42. Risk transfers upon delivery.
Article 12 - Duration transactions
43. Indefinite contracts may be cancelled with one month notice.
44. Fixed-term contracts last max 2 years and may convert to indefinite.
Article 13 - Payment
45. Payment must be made within 14 days.
46. Prepayment may not exceed 50%.
47. Incorrect payment details must be reported.
48. Late payment may result in reasonable charges.
Article 14 - Klarna payment methods
49. Payments are processed via Klarna Bank AB (publ), Sweden.

Article 15 - Complaints procedure
50. A complaints procedure is in place.
51. Complaints must be submitted promptly and clearly.
52. Complaints are answered within 14 days.
53. If unresolved, a dispute arises.
Article 16 - Disputes
54. Dutch law applies.
55. Disputes may be submitted to the Thuiswinkel Disputes Committee.
56. Only after complaint submission.
57. Within 3 months of dispute.
58. Binding choice procedure applies.
59. Decisions are binding advice.
60. Committee will not handle cases of bankruptcy etc.
61. Specific jurisdiction rules apply.
Article 17 - Additional provisions
Additional or deviating provisions may not disadvantage the customer and must be stored durably.
Article 18 - Changes to terms
62. The entrepreneur may change these terms.
63. Changes apply after 30 days.
64. Customers may cancel if they do not agree.
Article 19 - Personal data
Customer data is used only for administration and communication and is not shared without consent unless legally required.
